Article 1. Presentation

The International Olympic Committee (hereafter the “IOC”) is organising a contest to select the design for the front side of the medal for the Lillehammer 2016 Youth Olympic Games, which will be held in Lillehammer, Norway from 12 to 21 February 2016 (hereafter the “Contest”).

Article 2. Candidates

Participation in this Contest is open to all individuals who have Internet access and an E-mail address, regardless of their country of residence, to the exclusion of IOC and Lillehammer Youth Olympic Games Organising Committee (hereafter “LYOGOC”) personnel, as well as all people who are directly or indirectly involved in the conception, carrying out or management of the Contest, particularly employees of third party service providers, their affiliates and the company that will make the medals (hereafter the “Candidate(s)”).

By taking part in the Contest, the Candidate who has not reached the age of majority under the applicable national laws and regulations of his/her country at the time of his/her registration confirms that his/her parent or legal guardian has consented to him/her taking part in the Contest and abiding by the Rules of this Contest.

Article 3. Contest Phases

The Contest includes the following phases:

3.2. Selection of Winners: June 2015

3.3. Modification of the Rules

IOC’s decisions on all matters relating to the Contest will be final and binding on all Candidates. The IOC reserves the right at its absolute discretion to vary, delete or add to any of these Rules from time to time without prior notice and without any compensation or indemnification being due to Participants. These Rules prevail over any provisions or representations contained in any promotional materials relating to the Contest.

3.4 Use of Registration Information

By participating in the Contest, Candidates authorize the IOC, to collect and process Candidates’ Registration Information in accordance with IOC’s privacy policy, available at IOC’s website (, for the purposes (i) of allowing participation of Candidates in the Contest and (ii) awarding of Prizes. The IOC may transfer Candidates’ Registration Information to its sub-contractors, as the case may be outside of Norway, or the European Union, insofar as such transfer is necessary for the purpose identified above.

Except as provided under the present Rules, the IOC will not share Candidates’ Registration Information with any third party without their express consent.

3.5. Compliance

All Applications must be in compliance with these Rules at all times. The IOC may, at any time, and based on its own appreciation, exclude any Application or any Candidate, if the IOC considers in its reasonable discretion that such Candidate committed a breach of the aforesaid Rules.

Participation in this Contest implies the full, complete and unreserved acceptance of these Rules. Non-observance of the conditions for participation set out in these Rules makes the participation in the Contest invalid.

Article 4. Intellectual property rights

4.1. Candidates acknowledge that the graphic elements sent within the framework of this Contest are free of rights.

4.2. Candidates fully guarantee to the IOC that they possess all the rights and authorisations in and to the elements comprised in their Applications. Candidates further warrant that submitted Applications do not violate any existing copyright or any other intellectual property rights or any other rights belonging to third parties. At the first request of the IOC, Candidates will provide copies of these written authorisations allowing them to use the elements belonging to third parties in and to their Applications.

4.3. Candidates agree not to publish, have published, disclose or use in any way, and for whatever reason, their Application without the prior written consent of the IOC. An exception will be made for the Contest period 25 March 2015 until 1 June 2015, i.e. during the Project Submission Phase, only in the manner defined in these Rules.

4.4. Candidates agree that a rights assignment agreement must be signed by each of the Winners and will form an integral part of the acceptance by each of the Winners as a condition for his/her selection.

4.5 Under such rights assignment agreement, each of the Winners irrevocably transfer and assign to the IOC, any and all the intellectual property rights to his/her Application, including, but not limited to, the right to transfer, reproduce, copy, publish, alter, adapt, modify, distribute or create derivative works of his/her Application, in any currently existing or future medium or form, without any remuneration (including any claim on any commercial revenues derived from the exploitation of the medals) for the Winner except his/her prize as foreseen by the present Rules of the Contest, and agrees that, to the fullest extent permitted by law, his/her Application will be the exclusive property of the IOC. Each of the Winners hereby waives any rights to further compensation or remuneration associated with their Application.

4.6 Each of the Winners guarantee to the IOC that he/she is fully authorised to transfer the rights covered by the present assignment of rights, and that, in the event that he/she is a member of a copyright association and/or collective management organisation to which he/she has previously transferred rights to future works, that he/she has obtained the agreement of the aforesaid association or organisation that the Application submitted within the framework of this Contest will be expressly excluded from the general transfer.

4.7 Each of the Winners also agree to provide to the IOC, at its request, the source files for his/her Application (EPS format), and any document evidencing his/her ownership of the intellectual property rights over their Application and the assignment in favour of the IOC.

Article 5. Prizes

5.1 The Contest Winner will receive the following prizes:

5.2 The other Winners (i.e. the runner-ups) will receive a Samsung tablet.

5.3 The IOC reserves the right to modify the nature and/or value of the Prizes up to the day on which they are awarded.

5.4 In no event may the Prizes defined in section 5.1 and 5.2 above be exchanged for their value in cash or transferred to anyone, free of charge or against payment.

5.5 All Prizes are non-transferable. No substitutions or cash redemptions. Prizes may not be sold, bartered or transferred. Trip prizes must be used on date specified in section 5.1 hereabove, or Prize will be forfeited. Dates of departure and return are subject to changes. In the event there is a cancellation or pre-emption of the Lillehammer 2016 Youth Olympic Games, the IOC reserves the right to substitute a prize of equal or greater value. Airline tickets are non-reroutable, non-refundable and the validity may not be extended. Prizes do not include any additional expenses, including, but not limited to incidentals, telephone charges, travel insurance, souvenirs, upgraded transportation, additional ground transportation, meals, which are the responsibility of each of the Winners. Trip Winners and their guest must each travel together on the same itinerary and must have valid travel documents (i.e., valid passport, valid government issued photo ID) prior to departure. Potential Trip Prize winners’ travel companions (or parent/legal guardian if a travel companion is a minor) must execute a Release of Liability prior to departure. Winners and travel companions are responsible for obtaining their own travel visas or passports. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, meals, tips, entertainment and transportation to and from home residence to airport are the Trip Prize winners’ sole responsibility.

5.6 By accepting a Prize, each of the Winners release and discharge the IOC and its respective employees, officers, directors, representatives and agents from any liability or damage due in whole or in part to the award or Prize, acceptance, possession, use or misuse of any award or Prize or from participation in this Contest.

5.7 To the fullest extent permitted by law, the IOC gives no representation or warranty with respect to the Prizes provided under the Contest; in particular, the IOC gives no warranty with respect to the quality of the awards or Prizes or their suitability or fitness for any purpose. If any of the Prizes has a material defect, the Winners should return the Prize to the IOC in its original packaging. It is the Winners’ responsibility to verify the good functioning of the Prize immediately upon receipt; and Prizes will be considered as accepted within ten (10) days of their delivery to the Winners.

Article 6. Other

6.1 Within the limits authorised by law, Candidates have no possibility of recourse (with an ordinary court, a court of arbitration or any other court) regarding the Contest and in particular, but not exclusively, the results of the Contest. No correspondence will be exchanged regarding the Contest except to inform each of the Winners.

6.2 By participating in this Contest, Candidates agree to indemnify and hold harmless the IOC, its affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever (even to the extent resulting from the active or passive negligence of the IOC, and each of its officers, agents, servants, employees or other Candidates in the Contest) including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Contest or any Contest-related activity; the possession, acceptance and/or use or misuse of Prize and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action. Candidates who do not comply with these Rules, or attempt to interfere with this Contest in any way, may be disqualified. The IOC is not responsible if the Contest cannot take place or if any Prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

6.3 Publicity Release: For clarity, in consideration for permission for their child/ward to enter this Contest, any parent or legal guardian who so authorizes his/her child or ward to enter this Contest, hereby expressly grants to the IOC and the Contest entities the right, privilege and license to use your and such child/ward's picture or likeness in any photograph, movie, video production or any other forms of media publication and to use your and such child/ward's verbal or written statements or declarations for the purpose of publicizing, fostering and promoting the IOC and the Contest or for any other purpose.

Article 7. Use for information and promotion purposes

7.1 By taking part in this Contest, Candidates unreservedly agree that their names and Applications may be used and disseminated for information and/or promotion purposes regarding this Contest and/or the Youth Olympic Games on behalf of the IOC or any other individual or legal entity acting on its behalf, such as LYOGOC.

7.2 Such use of their names and Applications will be unrestricted and will not lead to any rights or remuneration (including any right or interest to revenues derived from merchandising or other commercial exploitation) which are expressly and irrevocably waived, and can be in any in-house or external communication medium for information and/or promotion purposes, as mentioned in the preceding paragraph, on behalf of the IOC or any other individual or legal entity acting on its behalf, for one year starting from the end of this Contest and throughout the world.

Article 8. Applicable law and place of jurisdiction

8.1. These Rules and the Contest are governed by Swiss law without reference to its conflict of laws rules.

8.2. No ordinary court, in any country, will be competent in the event of claims, disagreements or disputes relating to the Contest. If the restriction concerning the right of recourse (according to section 6 above) is judged invalid or void, all disputes will be submitted exclusively to the competent courts of Lausanne, Switzerland.

Article 9. Discrepancy

In case of discrepancy between the English and French version of these Rules of Contest, the English version shall prevail.
